Terms of Service

These terms govern your use of VoteOut at voteout.xyz (“the Service”). By using the Service, submitting a listing, buying time for a listing, or voting, you agree to them. If you do not agree, do not use the Service.

1. What the Service is

VoteOut is an entertainment product. Anyone may put a website on a public board of at most 20 entries, ordinarily by paying and sometimes, under a promotion, without charge (section 6). Visitors vote to keep or remove each entry. When an entry's countdown expires, the votes cast at that moment determine whether it is removed from the board or moved permanently to the Honor Roll. The complete mechanism is described on the How it works page and forms part of these terms.

2. What you are buying

A payment buys a display slot in a public vote. It does not buy placement, visibility, traffic, a minimum duration beyond the stated countdown, protection from removal, or any outcome. Removal by vote is the intended and ordinary operation of the Service.

3. How you accept these terms, and when

Every purchase starts on this site and completes on our payment provider's hosted checkout page. The material terms of the purchase — what it buys, that a vote can remove your listing permanently, that it starts immediately, and that the fee is non-refundable — are displayed on that page immediately above the payment button, and completing the payment is your acceptance of them. We store the exact wording that was displayed, together with the order and the time, so that both sides can see afterwards what was actually shown.

Where no payment is taken — a promotional listing under section 6 — there is no checkout page, and submitting the form on this site is your acceptance of these terms. The line shown beside the field states the two consequences that cannot be undone: that strangers vote on your listing, and that losing that vote bars the domain from this board permanently. We store the same record of what was shown against a free listing as against a paid one.

4. Immediate performance, and the right to cancel

Everything sold here begins the moment the payment clears: a listing goes onto the board or into the queue, extra hours are added to a countdown, a bid takes effect. There is nothing to deliver later and nothing held back.

If you are a consumer in the EU or the UK, you would ordinarily have 14 days to cancel a purchase made at a distance. Because you are asking for the service to be performed immediately, that right ends once performance begins. Before you pay, the checkout page states this in the terms shown directly above the payment button, and completing the payment is your express request for immediate performance and your acknowledgement that it ends your right to cancel. We store the exact wording you were shown with the order.

Nothing in this section affects rights you have that cannot be waived by agreement, including statutory rights where the Service is not provided as described.

5. Fees are non-refundable

Subject to section 4, all fees, including entry fees, extension fees, and bid increases, are final and non-refundable once paid. This includes the case where your listing is voted off the board, whether that happens minutes or days after payment, and the case where extra hours you paid for are cut short because the listing was voted out during them.

The one exception: if we take payment but cannot place your listing at all — for example the domain was banned or claimed by someone else while your payment was in flight — we will refund that payment in full. Contact hello@voteout.xyz with your order id.

Where a payment is reversed, by a refund we issue or by a chargeback you raise with your card issuer, what it bought is withdrawn: a listing comes off the board and out of the queue, purchased hours are taken back off the countdown, and a bid increase is undone. A withdrawn listing is not treated as having been voted out, and its domain is not banned. A listing whose countdown has already run and settled is not withdrawn, because the service was delivered in full and the result is part of a public record.

6. Free and promotional listings

We sometimes place a limited number of listings without charge. A free listing is offered at our discretion, in a quantity we choose and may change or end at any time, and nobody is entitled to one. Whether a given submission is free is decided when it is made.

A free listing is the same listing in every way that matters. It takes a slot on the board, the public votes on it, and if more than 50% of the votes cast when its countdown ends are to exile it, it comes off the board and its domain becomes permanently ineligible for listing here — exactly as if it had been paid for. Costing nothing does not make that removal, or the ban that follows it, reversible or reviewable.

Because no payment is taken, sections 4 and 5 have nothing to operate on: there is no fee, so there is nothing to refund and no right of cancellation to exercise over a price of zero. Everything else in these terms applies unchanged, including section 9 on what you may list and section 10 on domain identity and permanent bans. Extending a free listing's countdown and raising its position in the queue are paid in the ordinary way.

7. Buying time for a listing you do not own

The clock button on a board row is open to any visitor, not only the listing's owner. If you buy hours for a listing that is not yours, you are paying to keep somebody else's entry on the board: the hours are added to that listing's countdown and you acquire no ownership of it, no control over it, no right to have it altered or removed, and no claim against its owner. The purchase cannot be reversed because the owner later changes, removes, or alters the site, and the fee is not refundable if the listing is voted out during the hours you bought.

Extensions cannot be bought for an entry with no countdown running, and buying hours never changes an entry's position on the board, which is set by votes.

8. Ranking disclosure

Position on the board, in the queue, and on the Honor Roll is determined by payment and by public votes: board order by votes received, queue order by amount paid, and Honor Roll order by the frozen vote total at settlement. Nothing on this Service is a review, an endorsement, a certification, or an assessment of the quality, safety, or legitimacy of any listed website. We do not verify listed sites.

9. What you may list

You may only submit a website you own or are authorized to submit. You may not submit another person's profile, page, or content in order to expose them to a vote. Listings must comply with the Content Policy. We may remove any listing that breaches these terms, without a refund of the entry fee or of any extension bought for it, by you or by anyone else.

10. Domain identity and permanent bans

Listings are identified by registrable domain (for example example.com), determined after following redirects and stripping query parameters. Subdomains, paths, and tracking parameters do not create a new identity. If a domain is voted off the board it is permanently ineligible for listing, and attempts to re-enter it under a different URL that resolves to the same domain will be rejected or removed without a refund.

11. Voting

Voting is free. One vote per visitor per listing, and votes cannot be changed. We use a browser token and a device fingerprint to prevent casual repeat voting. We do not guarantee that the vote is proof against determined manipulation, and vote totals are provided as-is for entertainment. We may discard votes that we believe to be automated or coordinated abuse.

The Service also counts how many people open a listing's link, once per browser. This figure is displayed for interest only. It does not affect board position, the countdown, or settlement, and it is not audited traffic measurement — do not rely on it as such.

12. No gambling, no prizes

Payments buy a display service. There is no pool, no wager, no payout, and no prize. Nothing of monetary value is won or lost based on the outcome of a vote.

13. Availability and changes

The Service is provided “as is” and may be interrupted, changed, or discontinued. We may adjust prices, the board size, or the mechanism; changes apply to listings purchased after the change. If we discontinue the Service entirely, listings then on the board with a running countdown will be given notice by the means we have available.

Where the Service serves no visitor for a sustained period, that time is measured automatically and added back to every running countdown before any listing is settled, so that no listing is decided on votes cast during a period when the board could not be reached. We do not distinguish between the Service being unavailable and the Service being unvisited, and apply the same credit to both. This is the only remedy we offer for downtime; it is not a refund, and no fee becomes refundable because of an interruption.

14. Liability

To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the amount you paid us in the twelve months preceding the claim. We are not liable for lost profits, lost traffic, reputational harm, or any indirect or consequential damages. Some jurisdictions do not allow these limitations, in which case they apply to the fullest extent permitted.

15. Payments and tax

Card payments are processed by Stripe on our behalf. We are the seller of record: your contract for the listing is with us, not with Stripe, and your card details never reach our servers. Your purchase is also subject to Stripe's own terms for the checkout page it hosts.

Prices shown on this site are the amount you pay. Where sales tax or VAT applies to your location it is calculated at checkout and is included in that amount rather than added to it, and the tax is accounted for by us.
